Is Medical Marijuana (MMJ) legal in Ohio?

Yes. Medical marijuana was made legal in Ohio on September 8, 2016 with House Bill 523. This bill allows patients with physician approval to obtain and use medical marijuana. 


Is Recreational Cannabis legal in Ohio?

No. Recreational marijuana is not legal in Ohio, however, cannabis use has been decriminalized. The penalty for possession of up to 100 g is a minor misdemeanor with a $150 fine.

Cultivation Tiers Defined:

In Ohio there are two tiers for Cannabis Cultivation and both are based on the initial size of the cultivation area. Licensees may submit an expansion request pursuant to the cultivator rules.


Level I - Up to 25,000 square feet initial cultivation area 

Level II - Up to 3,000 square feet initial cultivation area 


Restrictions:

The current application period for cultivators is closed, no new cultivation licenses will be considered in Ohio at this time.

Associated Costs

The cultivator licensing fees are non-refundable and are as follows:


Application Fee

Level 1 - $20,000

Level 2 -  $2,000


Initial Licensing Fee

Level 1 - $180,000

Level 2 - $18,000


Annual License Renewal Fee

Level I - $200,000

Level II - $20,000

OHIO METRC COMPLIANCE

Ohio has been using METRC since the medical marijuana program inception in 2017. METRC has been the only track and trace provider for the Ohio legal cannabis program.
