Is Medical Marijuana (MMJ) legal in Nevada?

Yes. Medical marijuana has been legal in Nevada since 2000. The Regulation and Taxation of Marijuana Act was put in place on January 1, 2020 in Nevada. This law allows adults over 21 to legally possess up to 1 ounce of cannabis or up to 1/8 of an ounce of concentrated cannabis. Adults are able to consume cannabis on private property where it has not been prohibited by the property owner.

Cultivation Tiers Defined:

Nevada does not separate operators into tiers, however, separates all licenses by establishment type. Cultivation is one facility type that acquires, possesses, cultivates, delivers, transfers, transports, supplies, or sells cannabis and related supplies to a cannabis sales facility; cannabis production facilities; or other cannabis cultivation facilities.  


Cannabis cultivation must take place in an enclosed locked facility. “Enclosed, locked facility” means a closet, display case, room, greenhouse or other enclosed area that meets the requirements and is equipped with locks or other security devices which allow access only by a medical cannabis establishment agent and the holder of a valid registry identification card.


Restrictions:

Adults at least 21 years old in Nevada are able to grow up to 6 cannabis plants as long as those plants are in a locked location and not viewable publicly.

A medical cultivation license costs $3,000 at application and $1,000 at renewal. A recreational cultivation license costs $30,000 at application and $10,000 at renewal.


A medical production license costs $3,000 at application and $1,000 at renewal. A recreational production license costs $10,000 at application and $3,300 at renewal.


A medical dispensary license costs $30,000 at application and $5,000 at renewal. A recreational dispensary license costs $20,000 at application and $6,600 at renewal.

NEVADA METRC COMPLIANCE

Nevada has been using the METRC system for track and trace since December of 2017. All licensees must report their establishment data via METRC in Nevada. Prior to December 2017, MJ Freeway had been used for track and trace in Nevada.


METRC provides its seed-to-sale system for end-to-end plant monitoring. METRC is responsible for the implementation of the technical and operational components of the statewide track and trace system.
