Is Medical Marijuana (MMJ) legal in Maine?

Yes.  Maine passed an Act to Permit the Medical Use of Marijuana on November 2, 1999 through a ballot measure. 


Is Recreational Cannabis legal in Maine?

Yes. Recreational Marijuana was legalized in 2016 in Maine by the Marijuana Legalization Act.  Adults 21 years and older can possess up to 2.5 ounces of cannabis, including no more than 5 grams of cannabis concentrate.

Cultivation Tiers Defined:

In Maine the tiers for cultivators are defined as follows:

In Maine, cultivation tiers are defined as follows:

Tier 1 - up to 500 sq ft of canopy

Tier 2 - up to 2,000 sq ft of canopy

Tier 3 - up to 7,000 sq ft of canopy

Tier 4 - up to 20,000 sq ft of canopy


Restrictions:

Adults who are 21 or older can grow up to three mature plants, twelve immature plants and unlimited number of seedlings for their personal use.

Associated Costs

Cultivation Licensing Fees in Maine are as follows for Adult Use facilities:

Application

Tier 1 - $100

Tier 2 & 3 - $500

Tier 4 - $500


License Fee

Tier 1 Plant Count based license - up to $9 per outdoor mature plant or up to $17 per indoor mature plant

Tier 1 Canopy based license - up to $250 for an outdoor facility or up to $500 for an indoor facility

Tier 2 - up to $1,500 for an outdoor facility and up to $3,000 for an indoor facility

Tier 3 - up to $5,000 for an outdoor facility and up to $10,000 for an indoor facility

Tier 4 - up to $15,000 for an outdoor facility and up to $30,000 for an indoor facility

Expansion approval for a Tier 4 facility - up to $5,000 for an outdoor facility or up to $10,000 for an indoor facility for each approval

Package and Label Requirements

Adult Use packages must contain producer information, appropriate warning statements, batch and weight information, potency information and usage information.  


If Medical packages are labeled they must contain information about contaminants, cannabinoid profile or potency information.  Medical labels must be verified by a cannabis testing facility.
