Is Medical Marijuana (MMJ) legal in Mississippi?

Yes. On February 2, 2022 Mississippi officially legalized the use of medical marijuana by passing the Mississippi Medical Cannabis Act (SB2095). The medical marijuana program is run by the Mississippi Medical Cannabis Program (MMCP). Patients may purchase and possess up to 84 g of flower or the equivalent infused product in a one month period. 


Is Recreational Cannabis legal in Mississippi?

No. Cannabis is not currently legal for recreational use in Mississippi.

Cultivation Tiers Defined:

In Mississippi the tiers for cultivators are defined as follows:


Micro-Cultivators

A. Tier 1 - canopy of 1,000 square feet or less

B. Tier II - canopy of more than 1,000 square feet but not more than 2,000 square feet


Cultivators

A. Tier I - canopy of not less than 2,000 square feet but not more than 5,000 square feet

B. Tier II - canopy of not less than 5,000 square feet but not more than 15,000.00 square feet

C. Tier III - canopy of not less than 15,000 square feet but not more than 30,000 square feet

D. Tier IV - canopy of not less than 30,000 square feet but not more than 60,000 square feet

E. Tier V - canopy of not less than 60,000 square feet but not more than 100,000 square feet

F. Tier VI - canopy of 100,000 square feet or more


Restrictions:

Mississippi cannabis cultivation is currently only legal for medical use. In addition, licensed cultivators are the only people who can legally grow marijuana plants,  patients are not able to grow their own.

Associated Costs

Mississippi Cultivation License Cost

The license application fee for standard medical growers and ranges from $5,000 to $50,000 with annual renewal fees ranging from $15,000 to $150,000. The license application fee for standard processors is $15,000 with an annual renewal of $20,000.  

In addition to standard licenses, Mississippi allows Microbusiness, which meet specific size requirements, to become licensed as low as $1,500 for the inital license and $2,000 annually.
