Is Medical Marijuana (MMJ) legal in Missouri?

Yes. On November 6, 2018, Amendment 2 passed with a 65% vote, legalizing the medical use of marijuana for qualifying Missouri patients. A month later, it became Article XIV of the Missouri Constitution. This allows qualified patients or their caregivers to purchase up to four ounces of dried, unprocessed marijuana or its equivalent in a 30-day period. They must present a DHSS-issued ID card at a licensed Missouri dispensary to do so.


Is Recreational Cannabis legal in Missouri?

Yes, but going into effect soon. On November 8, 2022, Amendment 3 passed legalizing possession, cultivation, and licensed retail sale of cannabis for those 21 and older. This made Missouri the 21st state to legalize marijuana for adult use. This allows adults to possess up to three ounces of cannabis and cultivate at home up to six flowering plants, six immature plants, and six plants under 14 inches for their own personal use. The amendment has not yet gone into effect but is expected to soon.

Cultivation Tiers Defined:

Pursuant to 19 CSR 30-95.010(12), an indoor enclosed locked facility should be a stationary closet, room, garage, greenhouse, or other comparable fully enclosed space equipped with locks or other functioning security devices that permit access to only the qualifying patient(s) or primary caregiver(s) who have informed the department that this is the space where they will cultivate marijuana.


An outdoor enclosed locked facility should be a stationary structure that is enclosed on all sides, except at the base, by chain-link fencing, wooden slats, or a similar material that is anchored, attached, or affixed to the ground and that cannot be accessed from the top. The plants cannot be visible to the unaided eye from an adjacent property when viewed by an individual at ground level or from a permanent structure at any level. Finally, the outdoor structure must be equipped with locks or other security devices that restrict access to only the qualifying patient(s) or primary caregiver(s) who have informed the department that this is the space where they will cultivate marijuana.


By rule, an applicant can only cultivate in one single location at any given time. However, an applicant can submit both an indoor and outdoor location description, provided that the applicant clearly specifies when they will be growing inside and when they will be growing outside.


Restrictions:

Missouri cannabis cultivation is currently only legal for medical use, but that should change soon with the passing of Amendment 3.

Missouri Cultivation License Cost

The license application fee for growers and processors ranges from $10,000 to $25,000. The license application fee for dispensaries and infused product manufacturing facilities is $6,000 to $10,000. For a complete fee schedule, see here. 


Each facility is required to hold a separate license. However, applicants are permitted to hold up to three licenses and multiple licenses may be utilized in a single facility. Once awarded, a cultivation license is valid for 3 years, after which time it must be renewed.

Package and Label Requirements

The only medical marijuana required to remain with or in a particular packaging is medical marijuana purchased from a dispensary. Patients and caregivers licensed for cultivation are also authorized to possess their own, cultivated marijuana, and there are no regulations regarding packaging for that medical marijuana.

On December 6, 2018, the Section for Medical Marijuana Regulation (SMMR) was created within the Missouri Department of Health and Senior Services (DHSS) to oversee the Medical Marijuana Regulatory Program (MMRP).
